In case you can’t muster up some compassion for Charlie Sheen, who would make far more bucks to get a day’s work than many of us will make inside of a decade’s time, I guess I can’t blame you.

Marco Arment, the former CTO of the Tumblr blog platform, is best known these days for his time-shifting reading app Instapaper. But he could start a side-job as a financial advisor to start-ups. His motto: Get the money from your customers, not investors.


Arment’s more traditional take is built largely on the idea that if he puts out a good product, there’s no shame in asking customers to pay for it. And the more they pay, the less he needs to rely on outside investors. Arment said many developers are of the mindset that they need to amass a huge number of eyeballs through free services. But they don’t focus enough on building a solid product that can command loyalty and payment from consumers, and instead try to gain profitability through advertising and turning to outside venture capital.


By contrast, Arment says his efforts to monetize Instapaper have been successful because he was able to leverage the hard work he put into his paid versions and the good will he’s gotten back from consumers. And that has allowed him to avoid outside funding, something he plans on doing for the forseeable future.


Don’t Take Funding if You Don’t Need It


“If a service can be profitable and breakeven without VC money, you don’t need to take it,” Arment told me in an interview. “There’s no reason for developers to get a lot of users without charging. There’s another path. My goal is to spread that message: Charge for something and make more than you spend.”


Arment launched Instapaper as a free website in January 2008 and became profitable later that fall when he first began selling a paid iPhone app alongside a free version. He’s been profitable ever since. Arment won’t disclose his revenue, but he said he can cover his expenses and can afford to hire a couple more people if he needed. He left his Tumblr job in September to devote himself to Instapaper.


Though Arment maintains a free iPhone app, he said the focus of the company has been on the paid versions which are updated first (a new update is expected in the next month or so). He has yet to release a free iPad version and has only gotten three emails about the lack of it. Most seem happy to pay for the $5 iPad version. Between 25 and 33 percent of people pay for the $5 paid iPhone version. In fact, as an experiment, he pulled the free iPhone app from the app store for a week a little while back and found that only one person emailed. Sales of the paid version didn’t go up, but they didn’t go down either, he said.


“The free version isn’t really competing as much as I expected with the paid version; a lot of people go straight to the paid version,” he said. “It was only a week but the people who were going to the free version would not have gone to the paid version.”


Let Users Thank You by Paying You


That’s what’s allowed Arment to really focus on the paid segment. In fact, he still questions the value of the free version at times because it can leave a more negative impression for users with its limited set of features. Arment said his paying users have surprised him with their support. He started a $1 a month subscription plan in October that didn’t actually offer much in the way of extra features. It was more of a way to let users show their support for Instapaper. He said the response was overwhelmingly positive.


“That was a huge surprise to me how well it’s doing given there’s no real incentive to do it besides good will. But it ends up that good will is powerful,” Arment said. “It shows that people will pay for something they like because they want to ensure its future.”


Arment is testing the theory again with a new API that leverages his subscription plan. For developers who want to build apps with Instapaper integration, Arment said last month he will require their users to subscribe to Instapaper. Again, the response has been very positive, said Arment. Two hundred developers have applied to get access to the API. All this money-making has allowed Arment to sidestep venture capital money. He has had repeated offers, but Arment said accepting VC funding is akin to taking on a new boss, and the act of raising and maintaining money is a full-time job, he said.


Venture Capital Is Like Having Another Boss


“If you can go without funding, you can be a one- or two-person shop without a whole level of bosses,” he said. “You’re not worried about getting more money and getting diluted anymore.”


Arment’s approach doesn’t work for everyone. He was fortunate to be able to this as a side job and build it up while at Tumblr. And he acknowledges that the lack of funding could be a problem if he wanted to build a staff quickly. But he believes his experience shows that a more old-school approach to building a business and developing a following with consumers is a viable one for entrepreneurs that should be explored more. He may not the biggest company, but he can be a profitable one for a while.


“I don’t need the entire market,” Arment said. “I can get five percent of the market and be rich.”

A lawyer representing a former Zuckerman Spaeder client in a legal fee dispute in Washington told a federal appeals court today that the case belongs in arbitration.



The attorney, David Holzworth of Yoss LLP, who represents James Auffenberg Jr., asked the U.S. Court of Appeals for the D.C. Circuit to reverse a trial judge’s refusal to move the dispute from court to arbitration.



Zuckerman lawyers represented Auffenberg in a criminal tax case, winning acquittal for the St. Louis-based automobile dealer. The firm alleges Auffenberg owes more than $834,000 on top of the $1.5 million he has already paid. Auffenberg’s lawyers argue the firm said he would have to pay no more than $1.5 million. The firm sued Auffenberg in Washington’s federal trial court.



Auffenberg’s attorneys moved to stay the fee case in the U.S. District Court for the District of Columbia almost a year into the litigation. Judge Reggie Walton rejected the effort, saying Auffenberg “actively” participated in the litigation and failed to timely invoke arbitration. More background on the case here and here.



Holzworth said today in court that Auffenberg asserted his arbitration rights orally at the beginning of the litigation. He noted there was no “substantial” discovery in the litigation before Auffenberg moved to stay the proceedings.



Zuckerman lawyers are advocating an “extreme” standard that would require a client to invoke a right to arbitration of a fee dispute before answering a complaint, Holzworth said in court papers filed in December.



Zuckerman partner Francis Carter, representing the firm, argued today in the D.C. Circuit that Auffenberg’s participation in the litigation meant he waived his right to mandatory arbitration. Carter said there were numerous “mile posts” at which Auffenberg could have asked for arbitration.



“If he wanted to arbitrate, he knew how to start it,” Carter said. In court papers, Carter noted that Auffenberg responded to the initial complaint and subsequent amended complaints, among other documents. Auffenberg, Carter noted, did not assert arbitration as a defense.



Judges Douglas Ginsburg and Merrick Garland, sitting with Senior Judge Stephen Williams, did not immediately rule.



Undeterred by the persistently high unemployment rate and slow economic growth, Obama pledges to invest tall stacks of money on "infrastructure." This is what Obama means by "winning the future."

Chris Huhne will lead a review into the use of feed-in-tariffs (FITs) in the UK in a bid to end subsidies going to large scale solar farms rather than small scale users.


The Secretary of State for Climate Change acknowledged the successful take-up of photovoltaic panel in Britain so far since the FIT scheme began last year.


Since then 21,000 installations have been registered, with the majority of these apparently having domestic applications.


However Huhne highlighted his concerns that the subsidies were making their way into the pockets of big businesses rather than to small scale users.


 “I have become increasingly concerned about the prospect of large scale solar PV projects under FITs, which was not fully anticipated in the original scheme and could, if left unchecked, take a disproportionate amount of available funding or even break the cap on total funding,” said Huhne.


“Several large solar installations have already received planning permission. Industry projections indicate there could be many more in the planning system.”


Huhne thinks a procedural review may be necessary to address a number of problems.


 “In light of this uncertainty and the risk that such schemes could push FITs uptake off trajectory and may make the Spending Review savings difficult, I have decided to end the potential for damaging speculation and bring forward the review of the Scheme to look at ways of correcting these early teething problems.”


“I recognise that industry needs a long term plan for investment in which it can have full confidence,” he continued.


“Today I am announcing a comprehensive evidence based review in to the FITs scheme and, to provide further certainty to the renewables industry, I can confirm that we also hope to publish next month measures to support renewable heat within the envelope agreed at Spending Review."


The review of FITs will be completed by the end of the year, with tariffs remaining unchanged until April 2012, unless there is specific need for greater urgency.


Some say Huhne may be rather hasty in tinkering with FITs, including Ash Sharma, Research Director at IMS Research.


Talking to TechEye, Sharma says: “While it may mean that installation demand is pulled forward, with many businesses seeking to invest before any changes are implemented, in the long term it may damage both the commercial and residential markets rather than provide any benefits.”


“The government are perhaps concerned that the market may take off to quickly, alongside of course wanting to save money, but this may be too early in the UK market’s growth.  In fact the British market was only around one percent the size of the German one last year, having only had a subsidy programme for eight months.”


Furthermore, the UK is likely to fall even further behind other EU countries.


“We are way behind Germany of course, but we are also falling a long way behind many other countries such as Italy, France, Belgium, Greece and more.”


“This could in fact have a negative effect on the economy rather than helping it, with jobs for installations and distributors going if there is no demand for panels due to unattractive prices.”


“For example if the big businesses are not attracted to countries large scale solar plants then that will have a knock on effect on many others area, such as making component prices more expensive for residential users, which of course consequently means that there is less demand to have panels installed.”



Many thanks to Roddy Boyd for sending me over e-galleys of his new book on the implosion of AIG, Fatal Risk. (If you want me to read a book — I’m looking at you, publishers — then sending it over in electronic form makes it much more likely I’ll do so. I would never have read Zero-Sum Game, for instance, Erika Olson’s insider account of the CME-CBOT merger, had she not sent it to my Kindle. But she did, and I did, and I’m happy I got to read it.)


Boyd’s book is as in-depth as any autopsy of AIG will ever be and it does presume a reasonably sophisticated grasp of finance on the part of the reader. That’s smart, on Boyd’s part: he knows who his audience is for this book.


Boyd’s definitely done his homework here: he seems to have talked to almost everybody who matters, with the possible exception of Martin Sullivan, the hapless AIG CEO who ends up bearing the lion’s share of the blame for what ultimately went wrong. Sullivan’s predecessor, Hank Greenberg, is deeply flawed, of course, in part because he insisted on singlehandedly and personally being the key risk-control mechanism for an enormous company which no one man could possibly oversee in detail and in part because the company he so assiduously built managed to fail so devastatingly the minute he left. (On top of that, of course, there’s the question of his various prosecutions; Boyd is sympathetic to Greenberg on that front and very harsh on Eliot Spitzer.)


Boyd’s case that the AIG implosion would never have happened had Greenberg stayed on as CEO can never be proven one way or the other. My suspicion is that AIG was so big and Greenberg was stretched so thin, that ultimately AIG was certain to fail in any case. But the incompetence of Greenberg’s lieutenants is quite astonishing: Boyd writes at one point that neither Stasia Kelly, the general counsel, nor CFO Steven Bensinger, nor CEO Martin Sullivan had ever even heard of the “credit support annex” which proved fatal to company, by forcing AIG to put up billions of dollars in collateral when the CDOs it insured fell in value. And at a later point, Sullivan is astonished by numbers which had been carefully explained to him the previous day by the notorious Joe Cassano.


Cassano is certainly a very large part of the reason why AIG failed — his headlong rush into mortgages was a move which was explicitly ruled out by both of his predecessors at AIGFP, for good reasons, and he took full advantage of the fact that his boss, Martin Sullivan, lacked any ability to understand what he was doing or to rein in his excesses.


But in reality it was Win Neuger, with his idiotic and devastating securities-lending transactions, who probably did more harm to AIG than any other individual. Matt Taibbi told the Neuger story in his own inimitable style in Griftopia, but Boyd provides chapter and verse for anybody who really wants to understand the details.


When AIG failed along with various monoline insurers, the lesson that many of us drew was that no company should ever use its triple-A rating as a business model. If your triple-A is necessary for you to continue to make money, then you shouldn’t really have a triple-A in the first place: it’s a rating which should be reserved only for companies which don’t need it.


What happened at AIG, along with the other monolines, is pretty simple: they started taking their triple-A for granted, like it was some kind of fact of nature rather than a hard-won award which could be removed at any minute. Whatever else you might say about Hank Greenberg, he always jealously guarded his triple-A. But when he went, so did that culture.


There are no corporates any more, which rely on their triple-A rating for profits: even Berkshire Hathaway has been downgraded. That’s good. But there are still sovereigns. The UK strikes me as a little Greenbergian: it’s making deep fiscal cuts now, in an attempt to ensure its triple-A is never taken away. The U.S., by contrast, is more reckless, a bit like AIG after Greenberg left — it’s going after growth, first and foremost, rather than concentrating on its debt ratios. That might well be the right decision to make — especially if the U.S. could live with its bonds carrying a little bit of credit risk. But it’s a decision which should very much be made consciously and I don’t think that anybody has really done that.

Making Money on Line




If the president's budget doesn't get implemented, the government will end up running on a CR for roughly three straight years, a policy outcome few find optimal. But the closer politicians get to the 2012 elections, the less interest there is in governing.



"I find it hard to believe that they're actually going to be able to come up with a budget resolution that will pass both the House and Senate," said federal budget-watcher Stan Collender, a partner in the Washington, D.C. office of Qorvis Communications.



The House Republican leadership might conceivably be willing to find some common ground with the White House, but they've got the Tea Party to contend with, he said.



"Unlike Gingrich in '95 and '96," Collender said, referring to then-House majority leader Newt Gingrich, "these guys don't have the permission to compromise." The Tea Party "defines compromise as collaborating with the enemy.



"So I think there's going to be a shutdown," he said.



The current continuing resolution extends through March 4 at midnight. If there isn't new funding legislation passed by both houses and signed by the president before then, the government won't be able to spend money, and its nonessential parts will closed for business.



All that leaves Obama's fiscal 2012 budget proposal looking relevant "only in the macro sense," Collender said. The five-year freeze on domestic discretionary spending, for instance, certainly establishes a ceiling for funding.



But beyond that, he said, "this is a year when the individual proposals just won't be important."



If Obama's budget proposal dies a quiet death, it'll have few mourners. It has so far been savaged by liberals for slashing social programs and conservatives for raising taxes and not cutting enough.



"Despite his promises to make the U.S. a more attractive place to business in and do business from, President Obama is proposing $129 billion in tax increases on American firms doing business abroad. Not only will these tax hikes make U.S. businesses less competitive, but they would threaten jobs back home as well," complained Scott Hodge, president of the conservative Tax Foundation.



John Irons, research and policy director for the liberal-leaning Economic Policy Institute, had the opposite reaction. "The president's top economic priority should be job creation, but the proposed budget does too little and turns too quickly toward deficit reduction," he said. "The economic context -- unemployment at or above 9 percent for 21 months, unemployment that is expected to remain elevated for years -- demands a stronger response."

“It is not possible for anyone but Apple to sell e-books at a profit on iOS under these rules,” says Morin, founder and CEO of BeamItDown Software, which makes an e-book app called iFlow Reader and sells books via its own online store.


Apple’s new rules, announced yesterday, say that developers such as BeamItDown must make their products available through Apple’s own store, where Apple takes a 30 percent cut of revenues. The change will affect companies that make their content—everything from books to movies and videos to TV shows—available to owners of Apple devices.


Until now, Morin and others, like Amazon, have sidestepped Apple’s store by employing a clever workaround—when you click on a button to buy a book, you are taken out of the app to a browser, where the transaction takes place.


Morin says Apple has told him in the past that this was perfectly fine.


“The bottom line is that unless the FTC intervenes, this will put us out of business,” says one developer. “Given Apple’s political clout, this probably will not happen."


But now Apple has changed its tune. Its new policy says that booksellers can keep selling books outside the Apple store, but only if they also make the same books available inside Apple’s store as well.


Thing is, most customers will buy via Apple, because it’s more convenient. And that’s where the problem arises.


Morin says he makes less than 30 percent profit on the books he sells. So if he has to sell via Apple’s store, he will lose money on every book he sells. On a $10 book, he will lose $1.15.

“The bottom line is that unless the FTC intervenes, this will put us out of business,” Morin says. “Given Apple’s political clout, this probably will not happen. But there is no doubt that their practices are anti-competitive. We have a much better e-reader than Apple, but that is utterly irrelevant in the totalitarian world of iOS.”


Even the big guys, like Amazon and Barnes & Noble, will suffer under Apple’s new rules, Morin says. Amazon and Barnes & Noble did not respond immediately to requests for comment. Neither did Apple.


Worse yet, Morin says, Apple’s new policies will prevent small developers from dreaming up new ideas for the iPad. “This is the death of innovation in e-readers on iOS,” Morin says.


Apple’s new rules also have huge implications for companies like Netflix and Hulu, which sell movies and TV shows via subscription. Essentially, Apple is demanding a 30 percent cut of their ongoing revenues from iPads. That’s the price for making their content available to customers who own Apple devices.


There’s no sense fretting about whether or not this is fair. Apple has a right (and, indeed, an obligation, as far as its shareholders are concerned) to extract as much value as possible from the online ecosystem it has created.

It’s a common situation: new business owners need to advertise, but they don’t have the capital to do so early in their company’s operations. The dilemma is difficult. You can’t generate business without marketing and advertising, but you need money for marketing and advertising. Unfortunately, many of the small businesses will fail as a result of not advertising their products or services. If you operate a startup company, don’t fear: you’re not doomed for failure. Just take these tips into consideration:

Take Risks
You wouldn’t be in business if you weren’t willing to take risks. You may have taken out a second mortgage on your home, raided the nest egg, or scrimped and saved to start your business. It is a complete waste of all of that if you do not advertise.

Think of it like this. You take every cent you own (and borrow some) to buy a fantabulous car. Maybe a Hummer. But you don’t drive it. Maybe you’re afraid to. Or maybe you don’t know how to drive it. It sits in your driveway and rusts. All the money you spent was in vain.

If you spent that much money on a Hummer, wouldn’t you get in and drive it? Make the most of it? Likewise, with your business, you have to take a chance and advertise. If no one knows about your business, no one will visit your store or website. If no one visits, no one buys. If no one buys, you’re out of business.

You Can’t Afford NOT to Advertise
You may have no money coming in during the first few months of your business. So if you have no money, how can you advertise?

First of all, before you started your business, you should have made a business plan and budget. If you haven’t done this, stop reading and go write one immediately. Marketing and advertising should be built into your monthly budget, along with electricity, web hosting, inventory, etc. You need marketing just as much as you need electricity, at least in the beginning. Designate a percentage of the anticipated sales you plan (hope) to earn each month on advertising. It doesn’t have to be a lot. Maybe just 10%. If you hope to bring in $2000 in sales a month, that’s just $200 a month on advertising. That will get you Google AdWords ads, banner ads, brochures or other effective but affordable advertising.

If you’re using your personal finances to fund your business, cut out some of the unnecessary expenses, like going out to the movies or dining out, and use that for marketing. You’ll soon have more than enough income coming in to afford to do the things you enjoy.

All Advertising is Not Equal
Don’t waste your money on advertising that’s not going to be effective for your type of business. If you run a web radio station, brochures and flyers are a waste of time, because your audience is worldwide. If you run a doggy bakery in Sacramento, nationwide web advertising may not be for you. Think about who you’re trying to sell to, and then research advertising options.

Meet the Press
If you are brand new, or have recently launched a website, consider having a press release written. This news blurb about your new company/website can reach thousands of potential consumers. The people who read press releases are interested in the news, and choose to read your release. It’s subliminal advertising!

The key to any business succeeding is marketing and advertising. Word of mouth is only so effective. Don’t clip your company’s wings by not including advertising in your budget plan.
